From a jury verdict of first degree murder, and a sentence of death the appellant brings this appeal. On September 25, 1942, Dolores Catherine Smith, a little girl ten years of age, left the Woodruff School building in Little Rock at 3:45 p.m. in company with a man whom witnesses identified as the appellant herein. The child did not reach her home and her mother began a search for her. The next day the appellant herein (who was married to the sister of the mother of Dolores Catherine Smith) was identified as the man who left the school with the child and who was seen with her proceeding…
