This case is brought by plaintiff Rye Psychiatric Hospital Center, Inc. 1 (the “Hospital”), a provider of in-patient hospital services to Medicare-eligible patients under an agreement filed with the defendant Secretary of the United States Department of Health and Human Services (the “Secretary”) pursuant to 42 U.S.C. § 1395cc.
