Fred Pena, a retired Tampa firefighter, appeals a final summary judgment entered in favor of The Board of Trustees of the Pension Fund for the Firefighters and Police Officers in the City of Tampa (“Trustees”). Mr. Pena alleged that the Trustees paid an incorrect interest rate on the delayed payment of a “13th Check” from the pension fund. More specifically, he alleged that when the Trustees delayed payment, they held the funds in a separate interest-bearing account.
