DENTON, Chief Justice.

This suit was instituted by appellant, Melvin McCollum, against the Red River Valley Publishing Company, appellee, to recover damages resulting from an alleged libelous article appearing in appellee’s newspaper, “The Sherman Democrat,” on October 24, 1959. A jury was duly empaneled and heard testimony from both parties. At the close of the evidence the trial court overruled appellee’s motion for a peremptory instruction.
