Plaintiff’s petition was filed on August 25, 1941, under chapter 440, of the 1939 Code, and his amended and substituted petition was filed on January 22, 1946, under chapter 560 of the 1946 Code of Iowa. These chapters are identical and references herein will be to the 1946 Code. The pertinent sections thereof are as follows:
