Appeal from the District Court of the City and County of Denver. Eon. F. T. Johnson, Judge. Action by the Bishop and Chapter of tbe Cathedral of St. John the Evangelist against the Treasurer of the City and County of Denver. From a judgment in favor of defendant, plaintiff appeals. Reversed and remanded with directions to grant the relief prayed for. Decision en banc.

The appellant, plaintiff below, is an organization duly incorporated under the laws of Colorado for purposes other than pecuniary profit, viz: for religious, benevolent and charitable purposes. On the 22d day of June, A. D. 1895, John F.
