CONNOR, District Judge.

[1,2] Plaintiff declared, in two counts, alleging separate violations of Hours of Service Act (34 S'tat. c. 2939). The cause was submitted upon an agreed statement of facts, of which those material to the decision of the case are: Defendant, an interstate common carrier, on and prior to May 25, 1914, maintained at Kenly, N. C., a telegraph office, operated, during the day and night, for the purpose of sending and receiving orders pertaining to or affecting train movements.
