Affirming.

Tbe undisputed facts in this case as shown by the .record are: Many years ago Wood Sullivan, Sr., mar ried his first wife, and took up Ms residence on a farm in Boone county, Ky. There was horn of that marriage two children, Wood Sullivan, Jr., and the appellee, and plaintiff below, Yirgie L. Sullivan. In the latter-part of 'the nineties (the- exact date not being shown in the record) the mother of those two children died, the-boy being about ten years of age, and his sister (plaintiff) aboiit three years his junior.
