delivered the opinion of the court.

Helen Baltes obtained a verdict and judgment for $9900 against the Checker Taxi Company, awarded as damages for injuries suffered while she was a passenger in defendant’s taxicab. Following the denial of post trial motions defendant appealed.

The complaint filed on October 14, 1953, averred that plaintiff became a passenger in a vehicle owned and operated by the defendant, that she was in the exercise of due care for her own safety, and that as a result of one or more acts of negligence of the defendant the taxicab collided with…
