LAWSON, Justice.

This is an appeal from a final decree of the circuit court of Washington County, in equity.

The 75-acre tract of land situated in Washington County, which is the subject of this litigation and to which we will sometime refer hereafter as the suit property, was sold to M. C. Stallworth, Jr., in April, 1941, at a sale for division of proceeds between the alleged joint owners, F. L. Wilkerson and his brother, Albert Wilkerson.
