Arber, J.), entered on September 5, 1990, which, inter alia, denied plaintiffs motion pursuant to CPLR 3212 for summary judgment on the first and second causes of action, is unanimously modified, upon the law, to grant summary judgment on the first cause of action and award damages in the amount of $249,562.48 plus interest and to grant summary judgment on the second cause of action as to liability only and remand the matter for determination of a reasonable amount of attorneys’ fees, and otherwise affirmed, without costs.
