In October, 1905, appellant, J. F. Ball, shot and killed Jack Bolen in Middlesboro, Ky. He was indicted in the Bell circuit court for murder, and, on motion of the commonwealth, a change of venue was granted to the Knox circuit court. When the case was *604called for trial in the Knox circuit court, on motion of the Commonwealth, the indictment was quashed and the case referred to the Knox county grand jury, which returned a new indictment in two counts.
