*140The suit was-originally brought by the city of Louisville against Bertha B. O’Sullivan to enforce a tax lien on her property. The National Surety Company was made a party and asserted a mortgage lien on the same property. Fred Forcht intervened and asserted title to the property under and by virtue of a tax sale.
