THIS MATTER comes before the court on certain defendants’ motions to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim, to dismiss pursuant to Rule 12(b)(7) for fail ure to join necessary parties and defendant B.A.T.
