RODNEY, District Judge.
This case involves motions for summary judgment made by both parties, plaintiff and defendant, and motions of the defendant to dismiss certain paragraphs of the complaint. The case involves an accident happening at a railroad grade crossing called the Harmony Crossing in New Castle County, Delaware, on the early afternoon of June 28, 1948. On that afternoon the plaintiff was operating a passenger train in a southerly direction on Track No. 3 and approaching the crossing.
