The plaintiff in this action is Local 1029 of the Laborers’ International Union of North America (hereinafter the “Union”). Pursuant to 19 Del.C. Ch. 13 it is the certified exclusive bargaining representative of more than 300 employees of the Delaware Department of Health and Social Services, Division of Mental Retardation, Hospital for the Mentally Retarded at Stockley (hereinafter the “Facility”).
