This is an action of the case in assumpsit brought in the district court of the eleventh judicial district to recover a balance due on an account for services rendered. After decision for plaintiff a jury trial was claimed and the case was certified to the Superior Court. The case was tried before a justice of the Superior Court and a jury. At the conclusion of the evidence for the plaintiff the defendant moved for a nonsuit. This motion was denied. The defendant offered no evidence.
