This matter is before the Court on Plaintiff Rose Bogaert’s motion for a preliminary injunction. (Dkt. No. 2, Mot. for Prelim. Inj.) Plaintiff is the sponsor of an effort to place a recall vote against State Representative Andrew Dillon on the November 4, 2008, general election ballot. Defendant Terri Lynn Land, in her capacity as Secretary of State, determined that Plaintiffs recall effort did not gather a sufficient number of signatures after excluding signatures gathered in violation of M.C.L. § 168.957.
