This is an election contest under LSA-R.S. 18:364. The plaintiff appeals from judgment dismissing his suit upon exceptions.

The plaintiff, Crawford H. Downs, and the principal defendant, F. Jean Pharis, were candidates for the office of District Attorney for the Ninth Judicial District.1 According to the allegations of the petition, Pharis, the defendant, was certified as the nominee for that office following the Democratic Second Primary election held on August 27, 1960, upon the basis of returns showing that he had received 13,045 votes to 12,999 votes for the plaintiff, i. e., a majority of…
