JOURNAL ENTRY and OPINION
{¶ 1} Defendant-appellant Nicholas Myles ("appellant") appeals the decision of the trial court. Having reviewed the arguments of the parties and the pertinent law, we hereby affirm the lower court.

{¶ 2} On October 1, 2003, appellant pled not guilty to speeding and DUI violations and signed a time waiver. Appellant's attorney filed a motion to suppress, arguing that there was no probable cause and that appellant was not afforded the opportunity to consult with his attorney.
