MEMORANDUM
SYLVIA H. RAMBO, District Judge.
Before the court is a petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254, filed by petitioner Daniel Saranc-hak (“Saranchak”), a Pennsylvania inmate sentenced to death by a jury in the Court of Common Pleas for Schuylkill County, Pennsylvania, for murdering his grandmother and uncle. For the reasons that follow, the petition will be granted in part and leave will be given to the Commonwealth to conduct a new guilt phase hearing and sentencing hearing.
