A rehearing was granted in this case to give consideration to new points raised for the first time in the petition for rehearing. We will first restate our original opinion without substantial change.

Defendant has been convicted of the murder in June, 1946, in Los Angeles, of Police Officer Loren C. Roosevelt, and of the attempted murder in April, 1946, of two other officers. The appeal from the judgment of conviction of murder is automatically before this court by virtue of the provisions of section 1239 of the Penal Code.
