This cause was tried at September Term, 1889, of Mitchell Superior Court, which began 9th September, 1889, and adjourned on 21st September. The Fall Term of this Court began on the 30th of September, 1889. The ‘‘case on appeal” was settled by the Judge and filed in the office of the Clerk of the Superior Court, November 1. The transcript on appeal was docketed in this Court November 30, and the call of causes from the Tenth Judicial District, to which this ease belonged, began on 2d December.
