delivered the opinion of the court:

Defendant Roy Villanueva was found guilty of unlawful delivery of a controlled substance in violation of section 401 of Illinois Controlled Substances Act (Ill. Rev. Stat. 1975, ch. 56½, par. 1100 etseq.) following a jury trial. Defendant was sentenced to a term of imprisonment of not less than three nor more than nine years.

On appeal in this court defendant contends (1) that the State did not prove beyond a reasonable doubt that defendant was not entrapped; (2) that the trial court erred in refusing to instruct the jury as to the…
