This was an action commenced by the plaintiffs in error, plaintiffs below, against the defendant in error, defendant below, praying for a writ of mandamus requiring the defendant to cancel of record the taxes for 1921, not yet delinquent, assessed against certain real estate which the plaintiffs • had previously purchased from the county at a tax resale for the taxes of 1918 and 1919.

Upon trial to the court, the relief prayed for was denied, and it is to reverse this action that this proceeding in error was commenced.
