CHRISTIAN, Judge.

The offense is murder; the punishment, confinement in the penitentiary for 75 years.

It was charged in the indictment, in substance, that appellant, with malice aforethought, killed Will McWhorter by shooting him with a gun .

The homicide occurred on the 12th of April, 1935, in a field near the home of appellant. There appears to have been a controversy between appellant and deceased concerning the fact that deceased had rented some land which appellant had been farming.
