Plaintiff, while walking south on the sidewalk along the west side of Fifth street between Francis and Felix streets in the city of St. Joseph, Missouri, fell and broke his hip by reason of an accumulation of ice which had formed thereon at a point adjacent to premises owned by the defendant Brittain Investment Company. He brought this suit for damages against the city .of St. Joseph and the said Investment Company, the adjacent property owner.
