CUDAHY, Circuit Judge.
James Dugan, a disabled Vietnam veteran, received Social Security disability benefits until he was incarcerated for a period of two years. After Dugan’s release from incarceration, the Secretary of Health and Human Services reinstated his benefits. Two years following the reinstatement, Du-gan was notified that he had been overpaid to the tune of $40,000 because he had engaged in disqualifying employment seven years earlier (in connection' with the scheme underlying his conviction).
