NORDBYE, District Judge.

This action is brought to recover wages for overtime under Section 16(b) of the Fair Labor Standards Act of 1938, 52 Stat. 1060, 29 U.S.C.A. § 216(b).

The relevant facts appear to be as follows : The defendant, Barnesville Farmers Elevator Company, a corporation doing business under the cooperative laws of the State of Minnesota, has operated at Barnes-ville, Minnesota, during all the time relevant to this case.
