Juanita Jackson, the executor of the estate of Ella Kelley, appeals the trial court’s decision granting State Street Bank and Trust Company’s motion to dismiss.

Ella Kelley resided in her home in Dayton along with her husband Henry Kelley and their in-home care provider Anita Rutledge. On August 8, 1991, Mr. Kelley died, leaving Mrs. Kelley a $10,000 Metropolitan Life Insurance Company (“Met Life”) policy.
