On September 26, 1985, petitioners adopted Benjamin, a child born with severe brain damage, pursuant to an adoption subsidy agreement with the Sullivan County Department of Social Services (hereinafter the local DSS). Benjamin had been placed in petitioners’ foster care on April 9, 1984.
