This case is before the Court on the Magistrate’s Report and Recommendation on Petitioner Hughes’s Petition for Writ of Habeas Corpus. 28 U.S.C. § 2254. For the reasons set forth below, the petition shall be GRANTED.
Hughes was indicted in 1974 in Whitfield County for malice murder for killing Mur-phey Ridley. Attorneys Bobby Lee Cook and Sam Little represented Hughes at his trial in November 1974. The jury convicted Hughes of voluntary manslaughter and sentenced him to one year’s imprisonment. Fourteen years after his conviction, Hughes has yet to begin…
