HATHAWAY, Judge.

Defendant, Rutherford S. Hays, was charged with and found guilty of four counts of illegal possession of drugs. 1 The charges arose from events occurring on 3 September 1969 in Phoenix, Arizona. On that evening two officers of the Phoenix Police went to a residence on North 20th Street to serve an arrest warrant for illegal possession of marijuana on Miss Susan Pryde. Dressed in street clothes, the officers unsuccessfully tried to purchase some marijuana from Miss Pryde. They then informed her that she was under arrest pursuant to the warrant and followed her into the living…
