delivered the opinion of the court.

Reilly was indicted for an assault with intent to kill and pleaded not guilty, and was tried by a jury and was found guilty of an assault with a deadly weapon with intent to inflict a bodily injury where no considerable provocation appeared, as charged in the indictment, and was sentenced to imprisonment in the county jail for one hundred days and to pay a fine of $100 and the costs, and it was ordered that he stand committed to the county jail till the fine and costs were paid.
