This case comes before us in a somewhat unsatisfactory manner, and seems to show what is likely to arise, under the act abolishing special pleading, and more especially under the new practice act, in pursuance of the provisions of which this action is brought.
The plaintiff seeks to recover rent of part of a store, and declares as the assignee, under these circumstances, which appear from the declaration and the leases annexed thereto, and ‘the indorsements on the leases: On the 1st of May 1848, Sarah Hayward demised to Wildes P. Walker a warehouse on Long Wharf, for the term of eight years…
