Is the majority opinion herein a defiance of the expressed will of the people, the sovereign power of the *179state, and does it, by not adhering to the stabilizing rule of stare decisis, strike down many former decisions of the court and the interests affected thereby? My chief concern, and alarm, is the effect upon home-rule cities and last, but not least, the tendency to discredit and unstabilize the law and the weakening effect of the decisions of this court.
