The appellant was convicted of murder in the first degree for shooting and killing Paul Flueck in St.. Louis County and his punishment fixed by the jury at life imprisonment in the penitentiary. His motion for new trial in the circuit court contained thirty-two assignments of error. The Attorney General’s brief filed in this court last April covers all of these. The appellant’s brief was not filed here until more than six months later in October.
