delivered tbe opinion of tbe court.

Tbe appellant, T. M. Prine, jointly indicted with bis son, Joe Prine, was tried separately and convicted of tbe murder of D. S. Evans; whereupon, be was sentenced to serve a life term-in the state penitentiary.

Tbe controversy out of which tbe killing arose involved a dispute between Joe Prine and tbe deceased, Evans, as to tbe ownership of certain poles which previously bad been cut and peeled at tbe instance of Joe Prine and bis brother, Sam, and left in tbe woods where they were felled, on land claimed by tbe said Joe and Sam Prine under an…
