In 2005, complaints issued against the juvenile, *569charging him with delinquency by reason of indecent assault and battery on a person age fourteen or over in violation of G. L. c. 265, § 13H, and open and gross lewdness and lascivious behavior in violation of G. L. c. 272, § 16. Following a jury trial in the Juvenile Court, the jury found the juvenile delinquent on both offenses. Thereafter, the judge committed him to the Department of Youth Services (DYS).
