Background

The parties1 were married on August 28, 2004. There are three unemancipated children of the marriage: C.D., born xx/xx/xxxx; and twins, E. and A.D., born xx/xx/xxxx.

On May 14, 2012, Keri Defilippi filed an action for divorce against Kris Defilippi in this court (Defilippi v Defilippi, index No. 3137/2012), based upon the irretrievable breakdown of the marriage pursuant to Domestic Relations Law § 170 (7).
