This action was commenced by the Plaintiff Funds on September 7, 2010, to compel the Defendants to pay withdrawal liability assessed against Country Ford pursuant to the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1132, 1145, and 1451, in the amount of $92,435.00. On November 3, 2010, the Court noted the default of one of the Defendants, Vincent Caruso.
