The Summers County Board of Education (hereinafter Board) appeals an order of the Circuit Court of Kanawha County which reversed the decision of the hearing examiner and granted the appellee, Phyllis Parker, sixty days sick leave for the period of time she worked as a secretary for the Adult Basic Education (hereinafter ABE) Program. The Board contends that the appellee had no employee-employer relationship with the Board during the years she worked with the ABE Program, and that she is not entitled to the sixty days sick leave.
