Martha S. Thomson, filed a claim in probate court seeking the statutory allowance of $400 for a widow, and an allowance for a year's maintenance and support, from the estate of Peter Thomson, deceased, whose widow she claims to be. Her claim was allowed for $400 absolute allowance and for $1400 maintenance. Earl P. Thomson, a son of deceased and administrator of said estate, and Grace Richardson, a daughter of deceased, defendants, appealed to the circuit court.
