—In an action to set aside the parties’ separation agreement, dated December 15, 1994, the plaintiff husband appeals from so much of an order and judgment (one paper) of the Supreme Court, Westchester County (Nicolai, J.), entered March 11, 1998, as, after a nonjury trial, dismissed the complaint.
Ordered that the order and judgment is modified, on the law, by deleting the provisions thereof which dismissed so much of the complaint as sought to set aside (1) that part of paragraph 7 of the parties’ separation agreement which awarded the defendant maintenance in the amount of $52,000 per year…
