Defendant was convicted of the offense of arson in the third degree and sentenced to five years in the penitentiary. Defendant appeals. Held:

1. The state’s evidence shows that the defendant and a business partner, Evans, each owned one-half of the shares of a corporation engaged in the restaurant business with corporate headquarters and two of its places of business located adjacent to each other on Copeland Road in Atlanta, Georgia.
