• Thomas A. McLachlan was convicted of an assault with malice aforethought with a deadly weapon with intent to kill. Section 559.180 RSMo 1949, V.A.M.S. The assault occurred in Butler county. Defendant was granted a change of venue to Ripley county, and upon his application to disqualify the regular judge of the court, the Honorable Arthur U. Goodman, Judge of the Twenty-Second Judicial Circuit, was called in to try the case. The jury returned a verdict of guilty and assessed the punishment at two years imprisonment.
