Reversing.

A. M. Daughters appeals from a judgment convict ing him of manslaughter and fixing his punishment at two years’ imprisonment.

The homicide occurred at Kennedy’s Bridge in Gfar-rard county about 6:30 o’clock on the morning of July 7, 1932. Appellant’s wife owned a small tract of land and several cottages, which were rented to persons visiting Herrington Lake for fishing and other recreational purposes.
