This is an action brought by the plaintiff against Saverio Sarcione and his wife, Domenica Sarcione, by writ dated October 18, 1933, for money loaned to them at various times and in different amounts from October, 1924, to March, 1933. The defendants pleaded the general issue and the statute of limitations. The plaintiff, thereupon, filed a replication setting forth a payment on account and a new promise to pay within the statutory period.
