This case involves a contest between the plaintiff and defendant over *143which one of them has equitable title to a tractor trailer operated by plaintiff but with legal, record title thereto being in defendant’s name. Plaintiff claimed equitable title to the rig pursuant to an oral agreement with defendant, which was denied by defendant who claimed equitable as well as legal title to the equipment.
