-The plaintiffs, as part of the heirs-at-law of Anthony Francis, deceased, brought this action against the other heirs-at-law and C. O. Witte, Arthur Lynah and Edward H. Sparkman, for the partition of a certain tract of land, which they allege said Anthony Francis owned at the time of his death, a portion of which is in the possession of the said C. O. Witte, Arthur Lynah and Edward H. Sparkman, in which they claim some interest as trustees.
